Return Policy; Limited Warranty
Except as provided herein, all sales are final. Rapid Packaging does not accept returns or exchanges unless the products purchased fail to meet Rapid Packaging’s Limited Warranty described below because they are defective or damaged upon arrival. To request a return and make a claim of defect, please follow the policy below for approvals:
- Inspection. Customers must promptly inspect products upon their arrival, noting any defects, damage or discrepancy in quantity.
- Limited Warranty. Rapid Packaging warrants that, at delivery, products will be free from defects in material and workmanship and will meet the specifications agreed to in writing by Rapid Packaging. Notwithstanding the foregoing, Customer acknowledges and agrees that all products shall be subject to reasonable tolerances and variations consistent with standard trade practices and practical testing and inspection methods. Rapid Packaging makes no other warranties, express or implied, and any other warranty is hereby expressly disclaimed, including BUT NOT LIMITED TO FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR MERCHANTABILITY.
- Quantity. Printing is performed roll to roll, and Rapid Packaging cannot guarantee exact quantities. Production over-runs or under-runs not to exceed 10% on quantities ordered will constitute satisfactory quantities. Rapid Packaging will indicate the actual quantity delivered on the bill of lading and will bill for the actual quantity delivered within this tolerance.
- Claim Notification; Acceptance.
- All claims regarding product shortage, defects or damage must be made within 30 days after receipt of product. Please contact customer service at 763-404-8900. Failure to make a claim within such 30-day inspection period will constitute irrevocable acceptance of the products.
- Rapid Packaging may require Customer to ship product back to Rapid Packaging to verify a claim. All returns must have a return merchandise authorization (RMA) number issued by Rapid Packaging to be accepted for return. Customers are responsible for all shipping charges unless the product is defective or damaged, in which case Rapid Packaging will reimburse Customer for shipping charges incurred with documentation of such charges.
- Remedies; LIMITATION OF LIABILITY.
- Customer’s sole and exclusive remedy and Rapid Packaging’s sole liability, whether based upon warranty, contract or tort, including negligence, is limited to Rapid Packaging’s (i) supply of additional product to address a shortage; (ii) replacement of the printed products determined by Rapid Packaging to be defective; or (iii) refund of the purchase price paid for such defective products. Consumer customers may also have other rights, which vary from state to state.
- Rapid Packaging’s liability related to sales of products will be limited to the selling price of any products determined by Rapid Packaging to be defective and will in no event include special, indirect, incidental, or consequential damages, including lost profits or loss of Customer’s clients. Some states do not allow the exclusion or limitation of incidental or consequential damages for consumer customers, so the above limitation and exclusion may not apply.
